
Georgia’s Governor Brian Kemp has enacted Senate Bill 244, a statute that permits criminal defendants to request reimbursement for their legal expenses if a prosecutor is disqualified due to misconduct and the charges are subsequently dismissed.
This legislation was prompted by the prosecution of former President Donald Trump, led by Fulton County District Attorney Fani Willis, who was removed from the case due to an alleged inappropriate relationship with special prosecutor Nathan Wade.
Trump’s legal team incurred costs amounting to $4.2 million for the case; however, reimbursement is contingent upon the dismissal of the charges. Willis is currently appealing her disqualification to the Georgia Supreme Court, leaving the case in a state of uncertainty.
